Regarding the numbers at SCOTUS, it would be inaccurate to say this stay order was 6-3. We know that three justices would deny the stay: Sotomayor, Kagan, and Jackson. It takes five votes to grant an application. However, bc this is the emergency docket we don't know whether there was a sixth vote.
