The term "Champagne" is a Protected Designation of Origin (PDO), meaning it's legally protected and can only be used for sparkling wine produced in the Champagne region of France, following specific regulations. What ever fizzycrap you are producing in the US is not champagne.
Not really, just those who did before the trade agreement with the EU in 2006 were permitted to continue to pass off phoney goods. "California Champagne" is not a legally protected term in the US. Also it can’t be exported.
In a perfect world, that would be the case, but technically you're wrong. There are U.S. brands that are grandfathered due to having used Champagne prior to the establishment of the PDO.

Several us wineries use the term champagne before the treaty was signed between the US and the EU. These brands were allowed to be grandfathered in and can still use the term champagne.
