If you have a loved one or community member with an immigration hearing coming up at a court where ICE has been staging, have them fill this out as soon as possible to give the court sufficient time to respond!

My lawyer friend suggested that courts typically like to have people show up in person for criminal or immigration hearings so this will likely come down to having a sympathetic judge. That being said, there's no fee to file a motion like this and he thinks it's definitely worth a shot.

I’ve talked to a few immigration lawyers in court the past few weeks. What I’ve been told is that for hearings in the “master calendar” process, which is where I’ve seen ICE take many people, judges (in Chicago) are pretty lenient on granting remote hearings.

But “individual” hearings or other types, they are less likely to grant.

One of the Chicago judges also recently said she’d no longer grant online hearings for “individual” hearings but was still fine with “master calendar” hearings occurring on WebEx.
