as far as I can tell the DOJ strategy in these cases has pretty much been "just argue this indefensible position harder and be ruder to the judge"

IANAL but I have gathered from my friends who are that neither of these strategies has a great track record

Without justifying the breach of privilege that seems to have occurred here, one way to avoid embarrassment in cases of this sort is to heed your lawyers' advice, rather than making them defend a position they've advised you is indefensible.
