Is it caving? If Merchan had sentenced him to prison with term to be served immediately AFTER Trump’s 4 year term as president. SCOTUS would probably rule on an appeal that the 2024 election overrules NY’s conviction (or something like that). By delaying sentencing, SCOTUS has no ruling to make. IDK
Just going by this Robert’s SCOTUS’s *rule for the age* on DC immunity. They made a blanket precedent setting immunity ruling where none was called for. Maybe Merchan is trying to protect NY’s conviction from Robert’s corrupt court? (I am just guessing here btw. I’m obviously not a legal scholar)

When I was a prosecutor in upstate NY, we held sentencing six weeks after the verdict, like clockwork. On rare occasions, an appellate judge granted bail pending that court's review. We live in interesting times. 😡

To be fair, there are some civil punishments still against him. And he's probably more hated than any other American has ever been... and he doesn't have a wife to care for him in his old age.

It is disturbing, but I am hopeful there will be movement. State and federal legislation and opinions should not “mingle” in determining cases. Being an elected official should never be a free path to dismissal, nor should it ensure an immediate delay in sentencing. Gross!

Sorry, but they are right in the sense of what the order allows. It specifically allows the defendant, trump, to file a motion to dismiss under the statute allowing a dismissal in the interest of justice. The sentencing was adjourned to handle this motion
Technically correct, yes. I’m just pointing to the defendant’s immediate projection of victory as a tactic to claim a rigged system in the event of defeat.
How will Trump ensure he won’t be prosecuted or sentenced for anything after he leaves office? What will he do to ensure that doesn’t happen? That’s gotta be his number one priority as POTUS.
