The European Court of human rights is separate to the EU. A state can derogate from some articles but this is quite a step.

Goodwin v UK is ratio decidiendi in effect. It is a statement that a signatory nation to Human Rights law is in breach. Once a ruling is made it is binding and the state cannot just ignore it.

It also interplay with the HRA 1998 Act and DPA2018.
