It did bring a lot of clarity about the intentions and nature of the gender criticals though. Clarified in full view that they are haters committed to apartheid, exclusion, and a hostile environment for trans people, and generally attempting to prevent all forms of gender transition.

Well “lived sex” or “the gender role in which you present” is what is important in such contexts since it dictates whether you are - in practice - more likely to be accepted (vs causing disruption) in one space rather than the other.

We certainly cannot allow a social situation whereby if your lived sex no longer matches your sex assigned at birth you are deemed to be excluded from *both* male *and* female spaces. That is an intolerable and unsustainable situation in Equality Law.

It is also intolerable from the point of view of service providers, because it means that in practice they can no longer offer sexed spaces at all without being at severe risk of being sued by someone. And replacing all such spaces by single-occupancy unisex spaces will be outrageously expensive.

Oh I’m very aware of the legal arguments here (indeed I’ve made them) but I’m now in favour of making things crystal clear in the Equality Act, so that a “sex = sex assigned at birth” interpretation becomes simply impossible. Especially in Schedule 3.

You would indeed, but clarity is now needed in Schedule 3 that in single sex and separate sex spaces the default treatment is by the lived sex to which someone has been reassigned (if they have the protected characteristic of gender reassignment) rather than their original sex assigned at birth.

Also this only works for binary gender reassignment. Which space you are supposed to use if non-binary is a notorious insoluble problem. Less of a problem if you are gender fluid non-binary, but a major problem if your presentation is intentionally both male and female or neither male nor female.

In a context where only binary gender is legally recognised, you are probably safer going by whatever gender marker is on your legal id (including birth certificate if updated) but that is still a form of non-binary erasure.

I am a woman, so I open the women's. It takes a little bravery when someone is ranting about "Single Sex Spaces" but it's perfectly legal, and what I have done for 25 years. And at work, employers by regs should provide toilets "for men and women"- not "single-sex"- so women should use the women's.

Accidentally walked into the gents a few years ago (the signage was very confusing) and it was all quite embarrassing for everyone concerned!

In public, people will continue to go to the toilet they feel most comfortable in.

The hideous impact is on people at their workplace, college or similar. They will be told to out themselves by not using the toilet they're comfortable with.

And no woman will be safer.

Why focus on toilets? If women require separate, women only spaces, then why does this not apply in our ie women's everyday lives? Why don't they demand segregated leisure facilities, eating & drinking places, segregated schools, etc. What happens to their dignity when sharing spaces with others

They did, historically! Well, men demanded that women be segregated, and feminists argued it was unnecessary and purposefully alienating.

We already went through all this until bathrooms etc were the only spaces still segregated for their architectural specificity, and terfs want to take us back 🙄

It does not even tell which sex according to law is to be applied in many cases. Unless in some cases this decision is based on a more or less random definition by a doctor at birth time.

As far as I am concerned, until ECtHR says otherwise. That is the one I follow. Ultimately everything the govt or SC does is subject to that law and that is what's so scary in they are all ignoring it.
