Because competent attorneys keep resigning instead of signing things this administration tells them to. Well, except for the ones put on administrative leave for being honest in court.
he’s not incompetent. he’s arguing an impossible position because the government has taken a totally illegal, unethical and unconstitutional approach and told him to work it out. if he had any courage or principles he would have resigned. as it is, i can only assume he does not
Russia actually is a lot like this though lol. I mean, North Korea ain’t hot either, but the whole getting-disciplined-and-disappeared-by-the-state aspect is kinda overblown, they got other problems
It's primarily pointing out that Americans love to pretend abhorrent behavior is something beneath them, that they're incapable of and that it's a trait or culture reserved for Asians (or others in general) when in fact America has a long history of vile, disgusting behavior.
I have been an American for many decades and I never heard that or thought that. That makes no sense to me and no one I know thinks that. Please know this!
“Detention is not the norm with respect to visa revocation, as we had here. The executive branch made a specific decision to detain Ms. Öztürk that was motivated by her speech.”
Next up, the gov't is challenging the jurisdiction in the case pro-Palestine activist Mohsen Mahdawi', who was also arrested by ICE for his activism, but released by a Vermont judge last week.
This Ensign guy, how does he sleep at night? Delivering non-replies in federal court as a lackey to a DOJ in non-compliance with the constitution and rulings? He must have a prosthetic spine to hold him up and zero conscience. An embarrassment, or worse.
Trump's entire DOJ is filled with these knuckleheads, Emil Bove, Todd Blanche, Alina Habba, etc. They were laughed out of courtrooms defending Trump and now they're prosecutors. The one saving grace is that they're incompetent. Trump couldn't get first class lawyers to work for him.
"I don't have authority to take a position," says the government lawyer in answer to a judge's question??? Grow a set, quit, and start representing the people being victimized by the government! You're not immune from prosecution!!!
Imagine yourself as a lawyer, arguing in court without a position?!? I would skip the court hearing, drive to the south until the gas tank is empty and just walk to Antartica
Next question should have been: "Govt lawyers frequently take positions in court. Did someone specifically tell you that you could not take a position in this matter, in this proceeding? And if so ... who gave you that direction?"
He knows what happened to the last DOJ lawyer who conceded a point (that Abrego Garcia was deported by mistake). He's not going to risk going anywhere near any concession.
This is where a lawyer's personal interest conflicts with his other professional duties.

“Rümeysa Öztürk’s case is unprecedented and shocking. She has been held behind bars for six weeks while her health deteriorates for writing an op-ed.”
