Discrimination is legal in the UK if it's "proportionate".
The Supreme Court ruling (and draft guidance) explicitly cites this as a situation where it is. It's one of the reasons the ruling is so fucked up :/

The SC ruling sets up that you're allowed to exclude trans people from the toilets, what it doesn't justify is being discriminatory in who you ask for their bona fides in the first place.

It doesn't need to; that would be considered only indirect discrimination which is a *lower* bar than refusing us access. The ruling establishes that it's proportionate to discriminate against "someone whose presence may cause distress due to their appearance" -

they can openly admit that they don't check ID for pretty/cis-passing people and still be in bounds, the same as stores can admit they only check ID for young people who are buying alcohol.

I think appearance only comes into it for trans men - a cis woman would seem to be allowed regardless of her appearance. (And if she isn't that's another kettle of fish because she's also not allowed in the men's)
