Both common law & legal analysis are wrong. Arguing that illegal aliens are not subject to the jurisdiction of the USA b/c their illegal entry = entry w/o amity (i.e., in friendship & a desire to obey US laws) is a stretch. Illegal entry has never extended immunities similar to diplomatic ones.
