Non-lawyers have complained to me that the Courts are not effective since the regime ignores orders. Without getting into the weeds on that, how far-gone would we be if not for judges facilitating all of this information becoming public, and in a format that cannot credibly be spun by cable news?
it's important for us all to remember that the laws which grant executive power are the same laws that grant us protections against them. if they decide they're not bound by law, they are then wielding power with no authority and are subject to violent removal by the people
This was known at the time Rubio gloated over Öztürk’s abduction, and as part of the process he signed off on its “silent” aspect, the malevolent little fuck.
Of course the authors of the memo who at DHS, ICE and/or State who kept the revocation secret will likely face no repercussions for abusing/misusing "operational security." Hope I'm wrong.
also compelling: the methodical way of demonstrating how the gov't loses on every single factor of what they sought, and pointing out the absurdity of claiming she can't mount a challenge for failure to accurately name the custodian when they intentionally created that situation
Even were she released NOW the chilling of speech and violation of first amendment by Govt. will have happened. I can't imagine that VISA holders are writing many op-eds right now.
I don't even understand why this court gave the gov't a week to return her to VT. They should have been given the same time it took to get her to LA in the first place. More than that, she needs to be freed from custody NOW!
When they throw Blackstone at ya' to emphasize how utterly without support your argument is...well, you can stop reading right there because you know how the rest of the opinion is going to go.
On a more serious note though, the details in the opinion make it clear that the Trump administration is going to play games through all of this. Moving people around, concealing information, fashioning legal arguments bereft of any basis in law just to gum up the works.
In short, and this is hardly an original observation on my part, they're making clear they have no intent to follow the law. This is not going to end well.
