it seems the government's new strategy to avoid being held in contempt for running unlawful rendition flights is to classify the details of the flights and claim they can't be revealed to courts whose orders are likely being violated

Also, outside of the context of renditions conducted as covert action (eg the Bush admin's RDI program), I don't think I've ever seen the US government claim that the destination of transfer was classified.

I can see reasons to classify the schedule at a low level, but that should be able to be shared with the court.

I mean, "It's classified" has never meant that the information cannot be shared with anyone, just limited to those with a need to know. And I would think that would apply broadly to courts.

Unless you don't believe in due process, I guess.

It's been over 20 years since I practiced, but I remember a judge remanding someone to custody for contempt. Shortly thereafter opposing counsel and I had a conference with him in chambers. He made a comment to the effect that it usually takes a short time in the cell for them to get the message.

I will readily admit I don't know all of the ins and outs of doing that in Fed Ct but I'd love to see when of these DOJ clowns* get walked out of the courtroom in cuffs.
(I've always had respect for attys who enter public service, but if someone hasn't quit by now then they're complicit.)
