The rear attenuator on the Penske cars has been modified for a long time as seen in this photo from last years Indy 500.

IMHO if you put a car on display in your museum, you forfeit the right to later say 'oops, actually that's been illegal all along'.
But it’s clearly a bullshit excuse anyway. They did it because they believe it makes a difference. At 370 km/h I would certainly not dismiss it.
I’ve seen some minor stuff that made a significant difference in drag on cars doing half that speed.
Wonderfully detailed but also balanced and no hyperbole.
