There is no blame for Smith. None. The problem is the lack of spines in the democrats to rein in scotus. They did nothing. And our democracy will suffer badly and may die all together for it.

The Court Judges have failed to discipline their own ranks so good Judges are tarnished and incapacitated by the corrupt. This is a self-policing profession, and they have failed miserably.
Again, we failed to clear the lowest bar in the history of low bars and not one person has explained why. What does it take to save the nation? Democrats refused to take any action that mattered. I'll never forgive them.

If a Democrat had done this, the media would keep this the #1 story until they were jailed.

Yet the 11th Circuit saw it and took no action to stop it. Our Judiciary failed to act in good faith, all the way up to and including the damned US Supreme Court!

The entire year’s worth of legal battles was a debacle for the rule of law. It was a painful reminder that if you have enough money and or clout you can sway any outcome to meet your expectations.
Until the day I die I will never understand why the DOJ didn’t move to recuse Cannon. The fact that several months before this Judge illegally ruled twice to protect defendant. How much more of a bias/ prejudice could there be. One of the huge mistakes in these cases, #1 failure of Merrick Garland.
Which is why Cannon dismissed it. The SCOTUS immunity case would not have helped Trump, and the prosecution had him pretty much dead to rights. She had to gin up a reason to dismiss it.
No shit is all I can come up with. The republican benches, not even counting SCROTUS, have worked hard to give him cover and tear down democracy, especially FL and TX judges.
DOJ could have filed that case in NJ since Trump moved classifed documents there. I will never understand why they willingly consented to let a clearly partisan hack rule on this important case.
Agreed. DOJ lawyers ( including the AG) put too much faith in the system. I think they do not want to accept just how politicized a large segment of the judiciary has become.

But legal rulings alone almost never provide grounds for a judge’s disqualification, and, unfortunately the ‘impartiality might reasonably be questioned’ standard in practice just provides guidance for judges on when to recuse—it’s rarely grounds for a successful DQ on motion by a party.
The pivotal moment was the appointment of a feckless Federalist Society hack to be attorney general. Merrick Garland will go down in history as the AG responsible for the fall of democracy.

Yep, there was no downside to at least attempting to get her off the case. Just like there is no downside in the DOJ dropping the case against Nauta De Oliveira so that the report on the documents case can be released. Major missteps.
I’ll never understand so many things. People keep acting as if the trump magas play by the rules and time and again they don’t. We need to be much more cynical vs hopeful - ‘plan and assume the worst’ will have to be the strategy going forward.
In the OR untoward events happen. A failure to recognize and take the appropriate action escalates crises. Same for pilots. Same for similar life roles where your training shines in silence of preventative routine but demands zero hesitation in critical moments. Wishing away was a failure.
I don’t understand why she wasn’t off the case to begin with because of her lack of experience. She could have stepped away from the document case because she knew she didn’t have the type of experience needed and she proved not to have a spine.
I disagree essentially the Democrats for whatever reason known and unknown were the pivotal reason why justice wasn’t done.. too long dithering, too long procrastinating and very poor communication of the obvious known facts..

Trump should never have been allowed to walk around freely after January 6. The responsibility lies with weak political leadership, numerous journalists, and media outlets that normalized his behavior and continue to do so. The complacency of too many Americans has led us to where we are today.

Failed justice is a crime as well & ultimately we will all pay the price. You had four years & an entire federal government to hold him accountable. The more realistic answer would have been to say that judges are almost never disqualified because a party challenging a judge’s impartiality has a very high burden to overcome, even when everyone *knows* that the judge is significantly biased—making this showing is still often very difficult.
How did most of America realize this but Garland did not? Do we think Garland lied to Biden, stringing him along making him think he was doing more about Trump and the insurrectionists than he was? Was the Cannon a rigged choice?
