Is the contention that “pro due process” should have arranged for a better test case? That AOC should have had a (straight white male) Eagle Scout executed extrajudicially in Guatemala? Cuz that’s kinda what it sounds like.

This isn’t a situation where a “hero” is necessary. From the govt’s own admission, they didn’t really know who he was when they deported him, so who he was played no role in it. This has echoes of the retconning of George Floyd in order to justify his killing, after the fact.

She’s forgetting that Ernesto Miranda was an absolutely horrible human being. It isn’t about having a “poster child”, it’s about having procedures that protect the rightly or wrongly accused and give society confidence in the system.
I think it is part of the process to ensure compliance with the law and allow the defense to prepare for the case and shouldn’t be dependent on wealth. Trump used the tactic to get exactly what happened twice: take advantage of some bullshit “sitting presidents can’t be prosecuted” the DoJ made up.

I’d go as far to say Obrego Garcia had due process. He was barred from being returned to El Salvador by a judges order. After years of proceedings and appeals.

That ”due process” has nothing to do with the current situation any more than a robber getting due process 10 years ago changed the need for due process if suspected today. In fact due process would have raised his finding from before for a court to consider.

Well, those facts years ago resulted in a court order withholding his deportation. This was during the first Trump administration, and the court order was not challenged. So deporting him now without further proceedings is a violation of due process.
Even Scalia’s famous ‘it’s okay if the state kills innocent people’ presupposed that the innocent person was afforded due process.
But hey, maybe the lesson is that everybody in this Administration gets a one-way ticket to an Iranian prison come January, 2029. They’re not angels after all.
