If the EHRC with its interim guidance is actively misstating the law and egging on discrimination could they face negligence claims from businesses who wrongly follow this and are found to do so? Could the EHRC and its officers and board then face claims for assisting an act of discrimination ? .

Hate to criticise the barrister for the Scottish Government but was there a lack of these arguments in the appeal and were human rights interpretation arguments run. Also in terms of Pepper & Hart Theres a clear statement in 2009 by Vera Baird as SG that a cert would apply to EQA

We need to get back to fairness, inclusivity and love for the whole of society; this recent court ruling favours an exclusive part of society and I cannot bear exclusivity of this kind. Just don't stay with this, it's horrible, divisive, nasty! 🏳️‍⚧️
