A good question given that the Non-Detention Act (18 U.S. Code § 4001) prohibits the detention of US citizens w/o congressional authorization. "No citizen shall be imprisoned or otherwise detained by the United States except pursuant to an Act of Congress." No exception for temporary detentions.
