This is so procedurally weird. The Executive Branch suing a court isn't unprecedented; in fact, one of the most impactful natsec cases was officially called U.S. v. U.S. District Court. (You may know it as the "Keith" case because it involved Judge Damon Keith.)

the more i think about this the more i think that his campaign was a showcase for how centrists *say* they want democrats to campaign. the issue is that what this looks like varies from place to place. i would not expect mamdani to be able to win in virginia, but a mamdani-style campaign could!

Mamdani has actually increased his lead a bit in the latest update, to 8.3%. That's roughly 826K ballots... roughly 75% of the expected vote. Mamdani leads Cuomo 43.9% to 35.7%.

So, this happened. The article, published in 1950, describes a concentration camp bill that was enacted, funded, and ready to go into effect and would have been used to detain suspected communists without trial. It never did, and Nixon bowed under movement pressure to sign its repeal in 1971.

That this man is up for a judicial nomination is the perfect encapsulation of how these people fundamentally don't believe in law as a set of reciprocal social obligations. They only believe in unilateral power.

If the Court grants the DOJ's request, I don't think it's exaggerating too much to say that the Supreme Court would be affirmatively holding that the Trump administration has the right to violate court orders they feel are incorrect.

If your law is good when there are good people in office, but dangerous when there are bad people in office, your law is bad.

FWIW I’ve heard of tons of incidents where people are afraid to report DV, afraid to access medical care, or otherwise petrified to engage with the state in any way. It’s entirely understandable, and it will kill people, and that’s probably the point.

This is the use of the military for domestic law enforcement; I don’t see any other way to describe it.
