Trump’s latest retaliatory cancellation of all of Harvard’s federal contracts (whatever the harm to national security!) erases any doubt that he is trying to punish Harvard with a Bill of Attainder that the Constitution would forbid as a usurpation of Judicial Power even if Congress went along.

In U.S. v. Lovett (1946), the Supreme Court held that not even Congress, in a bill signed by POTUS, may cut off all contracts with a named individual or organization: that’d be an unconstitutional bill of attainder. Only courts can decide who deserves to be punished. SoTrump can’t do it with an EO!

Here’s the often overlooked reason Trump’s attacks on Harvard and others he singles out by name — including specific law firms, charitable organizations, radio and TV networks, and individuals — are flatly unconstitutional: they violate Article I’s absolute ban on Bills of Attainder: f.io/RnNoLD5I
