His team is likely relying on the President’s inherent authority to “repel sudden invasions” recognized in the Prize Cases (Civil War era). If this could be construed as a sudden hostile invasion by a foreign armed force, refusal to grant asylum to enemy combatants not shot dead could be justified.
When this goes to court, he won't be able to point to any constitutional provision to bypass immigration & asylum law instead of enforcing them. He has the charge to faithfully execute the laws of the United States, not replace them with executive orders. https://youtu.be/3IoYFFE-LJE
