Congress established USAID within the executive branch, the President does not have the authority to abolish it; congressional authorization is required to abolish, move, or consolidate USAID. Congress has not granted any further authority to the President.

These snippets suggest the argument is based upon the claimed "elimination" of an agency, which only Congress can do. The Trump "strategy" appears to be gutting USAID without formally terminating its existence. I hope the complaint is broad enough to clearly encompass what is actually happening.
