Thanks for this. However I don't understand why a person's biological sex is defined by sex assigned at birth? Can this be challenged if you have evidence of gender dysphoria and gender reassignment? And therefore claim given intersex is ignored you are the opposite sex for the purpose of the EA?

To my understanding, "bio sex = AGAB" is the defacto assumption at the moment as the Supreme Court did not define what they meant by "bio sex" in their ruling. So you probably could challenge it?

I meet more criteria of a woman than a man. So biologically I should be classified as a woman. My hormones were not that of a man even before HRT,I was a middle ground and had breast as a teenager. I've more characteristics of a woman now as I take HRT. But sex is definitely not binary by any means.

I have no idea if I am intersex, and like many who might be it's not exactly something that I was tested for, and honestly I don't care to be tested. I identify as a woman and should be treated as such, I'm not interested in being a gotcha argument, because the ruling is so unscientific anyway.

It's being challenged on numerous grounds because the ruling makes no legal sense. The British Medical Association described the ruling as 'scientifically illiterate' and 'nonsensical'. The ruling also makes things extremely complicated for people like me who biologically don't fit either box.
