It’s a little complicated. It’s a “renamed” actual agency called the United States Digital Service, so it technically should be operating under that founding statute. That’s how they’re getting around the “in this an agency” bit. Whether or not it’s acting within its constraints… probs not.

USDS is a service, not an agency. It’s more like a big office within an agency - the Forest Service is so big it operates more like an agency, but USDS is much smaller and more like the Federal Acquisition Service or the Public Buildings Service.
