The reason it is illegal is that Congress passed a law to stop Trump from changing the rates the last time he tried to do so.
The law is clear; the only real ambiguity is whether Trump still follows the law.

Never mind, there will be no vote. Trump et al are trying to create this constitutional realignment by ignoring the law and hoping the courts bless this radical idea.
But it is strategically foolish to concede that the rule of law is a fiction. Contest everything!
