The courts could probably find someone to reconstruct the answers to the first three questions and testify to that under oath. If the planes were a state secret, they shouldn't have been flying such that they could be tracked by the public.

They are going to throw bullshit at it, to keep it bouncing around the courts . rump will claim this, judge will hold hearing ,motions, arguments, then rule. Then THAT ruling will be appealed and start the whole thing over till it get to the SC. Then back down till the next motion filed

These are commercial charters. The contract would have to have had more than a business confidentiality clause.
If not a US corporation there is no cover after the fact. Transponders are a mandated by law and treaty safety tool.
