The judge w/ the two cases filed in Massachusetts questions whether they are "related cases," which requires the cases to involve "the same or substantially similar issues of fact." Based on the replies to posts I've made about this case, which usually reflect whatever the FedSoc strategy is for sowing doubt, the angle DOJ will take in defending this EO is that unauthorized immigrants aren't fully subject to the jurisdiction of the United States, so this doesn't apply to them.

Which flies in the face of the plain language of the amendment, history, common law, speech & debate, and over 120 years of precedent...

Or, just spitballing, because Wong Kim Ark's list of exceptions includes "children born of alien enemies in hostile occupation", maybe if they get SCOTUS to agree that civilian migration is an "invasion" under the law, if we're being hostilely occupied, automatic citizenship would not be conferred.
