There's certainly no reason for Biden NOT to do it. SCOTUS can weigh in afterwards. And the red/fascist states can scream all the bloody murder they want. If SCOTUS declines to review, then it's an Amendment!

Even if POTUS told AOTUS to do this, she does not have the authority to do so under the law.
3/4 did not ratify it. Only 35 states ratified the ERA by the deadline Congress set & extended, not the 38 required.

For those asking why the next steps haven't happened:
Congress passed the ERA with a 7-year time limit for ratification. That limit was not in the version that all states ratified, & ratification took far longer to occur. That's the heart of the legal battle.

I actually oppose this ATM. Strategically, doing this would be a huge mistake. At the start of his presidency I would be for it as long as the courts were packed. Now it would do more harm than good.

Thanks for asking. The reason why I oppose it is because doing so under the current circumstances will see it defeated (See: Supreme Court). It serves no tactical or strategic purpose in addition to that. Repositioning so that it does serve a purpose is too late.

What happened to "the rule of law"? A federal district judge (Obama) ruled ERA not ratified and "absurd" to certify. A DC Circuit panel unanimously (Obama, Biden, Trump) rejected the claim ERA had been ratified (on p. 25, crushed core argument against deadline). Archivist promised to follow courts.
