If one makes something and contribute to the production of that thing in a non-trivial way then one should get protections for your work and creativity. Just like using any other tool or software/filter/etc. Blanket denying copyright just b/c an algorithm touched something seems extreme.

This is good for artists who want to use smart tools.

Just typing in a prompt to GenAI isn’t going to be enough, which is good (though the prompt itself may be copyrightable)

Also this says nothing about whether training on copyrighted material is legal. This is about outputs, not inputs.

Thanks for the thoughtful response! I ultimately agree with you on allowing copyright protection for artists who use smart tools, but you have to admit that the phrase “in a non-trivial way” is doing a lot of the heavy lifting in that first conditional claim.
