In the scenario where someone is too ill to apply for Attendance Allowance themselves (which acts as a "gateway" benefit to many other state benefits), will it and any other benefits be back dated once a relative is eventually appointed as a deputy by the court of protection?

I think the claim can only be backdated to the date you asked for the form. Your relative can get help to complete the form.

It's not about help to complete the form, they lack capacity so cannot sign anything. The only path is getting deputyship via the court of protection, but it's taking months.

Yes, unfortunately in the 6 months they lost capacity, so now the only option is to go down the lengthy process to get a deputy appointed. Meanwhile, everything else is "gated" behind "are you claiming attendance allowance", it's a very frustrating system.

Myself and my mum get attendance allowance but we are not entitled any other benefits, even at the dentist we have to pay in full.

Sorry what I meant is, sometimes a person can only qualify for other benefits/services if they are claiming Attendance Allowance. For example, it's one of the qualifying criteria for a Council Tax reduction for someone living with mental impairment.

Is the person able to sign? Attendance allowance forms are online, I’d be tempted to help them complete it and get them to sign it if they are able to as I’ve never heard of it being backdated due to waiting for someone to be appointed.

Maybe complete the form and send it in with an explanation of the circumstances, some benefits take into account a date of claim so once the deputy ship has been awarded they will be able to go back to that date. Deputyships take so long I wouldn’t delay the claim if possible.
