Additionally, many people think IEPs are only for students with learning disabilities, but students with physical health issues are included.

Does your child have diabetes? Carry an EpiPen? Use an inhaler? Rely on any kind of medications?

These students will also lose their protections.

Parents can file a state complaint or a due process complaint in their state if they do not believe their child has received a free and appropriate education. The Office for Civil Rights handles claims of discrimination against people with disabilities

Unless Congress changes the law a child will still be entitled to a free and appropriate education in the public school system however states may bear more of the burden and services could be reduced

The feds supply about 18% of the excess costs of educating students on IEPs in grants to states which the state dept of ed distributed to local public school districts. The IDEA is not fully funded. Fed dept of ed also provides oversight and guidance to states. These tasks will need to be moved.

For students who need specially designed instruction to make progress in the curriculum and not just accommodations for access, they have IEPs. Both 504 plans and IEPs are controlled by federal and state law so Congress will need to rescind the law.

Most of the students you are referencing would be on 504 plans under the Rehabilitation Act for those with disabilities that need accommodations. Noncompliance with a 504 plan can result in a complaint to the Office for civil rights which is in the federal department of ed.

Also, ask me how I know. I had two sons with EpiPens & actually had to go through fighting the district to enforce their right to carry those EpiPens. We live in the Deep South where local School Boards didn’t realize how much trouble they could get in for refusing. They learned.

That’s the point. The point is to roll back to eugenics and the forced sterilization, incarceration or institutionalization of minorities, the disabled, mentally ill and LBGTQIA.
