Idk I heard on the Odd Lots podcast that the prognosis is Humphrey’s executor is dead except for a federal monetary policy reasons exception. How that would work is anyone’s guess when trump could fire them for a different reason.
Love the Odd Lots crew but that strikes me as wishful thinking. There’d be no real non-policy grounds for that exception. I can’t rule it out but I wouldn’t expect it.
Oh that's what they/interviewee said - that's the desired outcome these people want (and Alito indicated he's up for), even if there's no legal basis for that distinction.
But they also said Trump could just fire Powell first and dare the court to stop him, but even if they did the damage is done
If unemployment climbs high enough, Fed would likely drop rates anyway, right? And then DJT would take credit for it for the obvious wrong reasons, but perhaps not fire Powell.
Trump has already explicitly violated Humphrey's. I don't think the expectation should be that Trump will wait for it to be overturned by SCOTUS first.
Sure but Trump removed two FTC commissioner's in direct and explicit violation of Humphrey's and that's still playing out in the lower courts. My point is the Trump admin is acting like they aren't constrained by Humphrey's.
