1st: none of this is new. The problem was clearly IDd in the 2005-6 ESC SEND inquiry. My children had their first statements of SEN (the forerunner of the EHCP) in the mid-2000s. They were riddled with vague slop & poorly-evidenced interventions, & my kids paid a huge price for that

2nd: there is nothing specific to the EHCP construct that makes dire quality plans inevitable. Crap plans are a product of poor professional advice, corroded professional standards, & the conflict that comes when the organisation that writes plans is also on the hook for funding them

I've seen hundreds of SSENs and EHCPs over a decade and more: only 3 of those were legally compliant when finalised by the LA

This is one reason why LA outcomes are so dire at SEND Tribunal: most appeals now are about the contents of plans, not whether a child needs one

The common thread here is limbo-dancer-low professional standards & inert regulatory bodies, and the fact that the only barely functioning mechanism for rectification is a slow & sapping legal tribunal

Policymakers & their coin-operated advisers might use this evidence to argue that SEND provision via statutory plan is fundamentally flawed

It's not - tightly evidenced, tightly written plans work very effectively, as these people know from the detail of their own fucking contracts
