I mean how seriously is clement going to take this though. He could slap some one-pass work together and send it in, leaving ho to either do his own work to reject the dismissal or use the second best arguments to support it, which SCOTUS might notice.
He’s also a conservative adjacent to the fascist movement putting Adams on a leash. Who is he gonna try to win for and what happens when he uses his super-lawyer skills to further the goals of the movement he’s very much a part of?
He is going to win for the side of "this case should not be dismissed" because that is what he has been assigned to do. Good lawyers argue their point even if they don't agree with it personally. I think Clement is a good lawyer.
Anyone who accepts an assignment like this is going to take it very, very seriously. More people are going to read this brief than have probably read any other brief that he’s written.
How does it do that? As I read the order, Clement would be free to come back with a brief saying basically that Ho is limited to the party submission and should grant the motion.
i mean, technically yes (without going back and rereading), but the judge sought out his participation and he agreed. hard to believe he'd then take the counterposition.
It’s like a local businessman going to every lawyer in town for a consultation to try to get them all conflicted out of representing his competition. Except here, Paul Clement is the only lawyer he cares about!
