Not sure the House could get 2/3rds behind squashing a dubious, partisan pardon.

If we are already amending the constitution to rein in pardons, we could start by banning self-pardons, banning pardons for future crimes, and requiring the pardon target a conviction rather than a blanket pardon.

Horrible idea that would lead to vastly fewer uses of the clemency power rather than vastly more – which is what we need. In literally every other area of government we tolerate occasional terrible outcomes. We don’t curb the president’s power to make war when he kills an innocent civilian.

In earlier eras American governors and presidents used the clemency power far more often. It was once common for a governor to commute the sentences of 1/10th of all prisoners in his state. The nation with the largest population of incarcerated people in world history needs more clemency not less.

The fact that exactly one President, Donald Trump, may vastly misuse that power is a reflection on him and not on the constitution which correctly sees clemency as a core function of government. I don’t love Biden or Clinton’s use of it, but it was not a great tragedy. Trump is unique.

For the clarification list: Maybe this is inherent in the distinction between a pardon and commutation, but a president should still have the power to commute a death sentence, even while a lame duck, and even if the sentence would otherwise be carried out within 30 days.
