Yes, I think that’s accurate. At least he will try to do it that way. His proposed tariff against Mexico violates his own trade treaty he negotiated with Mexico in his first term that was enacted into law by Congress. Will Congress try to stop him in court? Unlikely.

I think he can do it without congress however since HE signed the last NAFTA he will get sued. the only way he does business is to try to renegotiate after the work has been done and kill the little guy in legal fees he is about to learn states have deep legal pockets and he can't run out the clock.

Emergency use only. Like one of our industries is dying due to another country’s tariffs. Or “national security risk”. Tomatoes and avocados don’t count. And the existing trade agreement with Canada and Mexico has a one year notice provision. So anything he tries “day one” will be illegal.
