They absolutely have a choice as the SC judgement makes a clear statement that protections from discrimination and harassment are unaffected. It's a naïve statement, as we're seeing, but it's what they said.

That does lend itself to taking action against a public sector body.

How would this sit with section 22 of the GRA.

If the government has come to know of a person's gender recognition status as an employer or even as the government who issued the certificate and then outs that person with a directive to use a specific toilet, that would seem to be a violation.
