The case shows the difficulty of SCOTUS acting on a TRO, as it expires next week anyway. So assuming district court judge doesn't change course, we'll be talking about this again in a few days when SCOTUS might decide to weigh in more fulsomely.

It's a TRO, widely regarded as unappealable. Really hard to make a showing of irreparable harm about a two week wait while it's carefully considering and some kind of record is established.

Also, it was Gorsuch and Alito who would have lifted it, not Gorsuch and Thomas.

Gorsuch drunk the Kool-Aid with respect to Humphreys and Myers, accepting Trump's assertion their applications were for "back pay only."

The principles died during litigation and their families took it up to settlement the estates.
