The RI TRO from Friday (Judge McConnell) stands.
and Daniel Schwei for DOJ.
Judge AliKahn asks DOJ's Schwei to start with the mootness question.
AliKhan interrupts and about the state of play, and the declarations saying agencies are still trying to implement it.
He says in a few instances agencies referenced the OMB memo and "each time" DOJ acted to correct those instances.
He cites the NSF website being wrong, "and they promptly updated their website."
DS: There's a separate TRO [from Rhode Island]. The money is going out the door, or at least I think so from the website.
Setting aside that, NSF funding, if paused, would not have been from the OMB memo, but from the EOs or its own policies.
