Citron astutely observes that I tell three interlocking stories. The first is that of the career of Stephen Bright, advocate for the poor and condemned.
The second story is that of the rise of war on crime politics and the eventual beginning of a reconsideration of the wisdom of this approach to dealing with crime and public safety.
The third story is about the effects of such constitutional politics on the rule of law. These procedural obstacles, expanded prosecutorial discretion, and parsimonious notions of equality and fairness continue to trip up the poor, racial minorities, and intellectually disabled.
