Siobhan Kelly begins with some housekeeping in regards to the statement of claim. There are teachers who performed work for the university consulting with students. The parties agree that the teachers did the consultations, but the Q is whether, under the EBA, they deserved to have been paid

There is an important jurisdictional issue to deal with first. Monash Uni has argued that the Federal Court has no standing to decide on a wage theft case going back to a previous enterprise agreement. Because the 2014 EBA has expired, Monash argues that a wage theft case on that EBA can’t be heard

This is actually a big deal: if Monash Uni wins the argument that wage theft under an old Agreement can’t be back paid, it would overturn a century of precedent that courts can enforce backpay for expired enterprise agreements. This will have big implications for workers across the economy

Now we turn to the definition of casual academics. They are “teaching associates” engaged casually to work various sessions on a session-by-session basis: tutorials, workshops, demonstrations, etc. One of these session types is a catch-all called “Other required academic activity”

A “tutorial” is defined as “any education delivery described as a tutorial”: the pay rates are paid per hour of tutorial delivered and assume 2 hours of “associated work”. If you deliver the tutorial, you get the tutorial pay (which assumes the 2 hours associated work).
