I think that's exactly right. You can realize that a murder charge, as opposed to manslaughter, was going to be a really heavy lift for prosecutors. That's quite different from the "great job, dude" chorus.

I think we should be cautious about reading a lot into this outcome. The same jury was deadlocked on the manslaughter charge. Eg there was at least one jury member who was convinced it was manslaughter but also thought it was not a negligent homicide!

What Nicholas & Josh are talking about are less along the lines of jury reasoning as it is about the folks reacting to the news of the verdict. Way too many are celebrating less b/c they think prosecution overreached, and more b/c they think it was righteous to kill a homeless black guy in general

That’s likely because people with a moderate take on the case don’t feel compelled to post about it. This was probably the right call. Daniel’s judgment wasn’t perfect but hardly criminal.

This also highlights the failure of the "righteous violence" rhetoric where the ethics of lawless killing turn on how popular and well liked the victim and perpetrator are.

And more often than not it's specifically how well liked the victim is. We're even seeing it with the lionization of the UHC assassination suspect, even after it was revealed he was a wild-eyed nut. We see the same in wide scope w/ police changing how murders are handled based on victims' race

The situation is awful. I’m just not sure Penny meant to kill anyone or put someone in a chokehold for fun. How can anyone know if someone threatening to kill people doesn’t mean it ?

The deceased seems more failed by the healthcare system than legal system.

I also think that a different kind of restraint should have been figured out in less than 6 damn min. 1 person per limb until police arrive. Something.

He should still be alive, but passengers should be safe from death threats and aggressive mentally ill citizens. It’s a failure no matter what.

I'll say it. Correct, or at least justifiable, verdict, but still a tragedy. Difficult to prove beyond a reasonable doubt that Penny "failed to perceive a substantial or unjustifiable risk" of death, constituting a "gross deviation from the standard of care" of a "reasonable person"...

When the guy's on the ground grappling trying to restrain someone who was a threat it's hard make the case that holding on too long, or using too much force, was a gross deviation. Doesn't make it right, just not a felony assault. As a NYC criminal defense lawyer, I expected this outcome.
