There's the crime-fraud exception to the attorney-client privilege, whereby third parties can try to prove that communications were made to further a continuing or future crime or fraud and therefore not privileged.

But the lawyer also has an ethical obligation under Rule 1.6 of the RPCs to keep all info relating to a representation confidential unless one of several narrow exceptions applies. It's too early to tell if this lawyer has any leeway under this rule; he should assume not unless advised otherwise.

well, no-but if the direction he got was, Find some kind of way to make X legal, he may have given the advice 'I can't' and the request itself (find a legal way to do X) might still be privileged. Not my field though.
