The leader of an insurrection can only be sentenced to either the death penalty or life imprisonment. In contrast, the leader of a military rebellion faces only one possible sentence: the death penalty.
Interestingly, the Korean Penal Code provides grounds for applying the charge of military rebellion to Yoon’s actions, and there is precedent to support this—ironically, from a case prosecuted by Yoon himself.
If Yoon is charged with military rebellion and found guilty, he will be sentenced to death. Under the Military Criminal Act, executions are to be carried out by firing squad.
Of course, South Korea has not carried out any executions since 1997. However, the death penalty itself still exists. Ironically, Yoon himself strongly hinted at his intention to reinstate capital punishment. Talk about karma.
