She has essentially pointed out to plaintiffs they have a better case. She wrote that the states had raised a “colorable” (that is to say plausible) claim under the constitution’s Appointments Clause, with “serious implications.” She follows the law, always.
Chutkan went on to say that even though the states’ larger case against Musk is “strong,” their arguments at this stage in the litigation were not good enough to satisfy the standard that must be met to warrant emergency action by the court.
If M u s k were smart he would get out of Doge now because after Reps lose the midterms, the new congress will go after him for tens of billions in civil lawsuits.
As would revoking his ill-gotten citizenship, seizing his ill-gotten assets, tossing him in Gitmo, and telling South Africa to come pick up their white trash.

That seems to be one of the democrats credos too.
Along with their propensity to write strongly worded statements and letters.
