DOJ, and newly confirmed Deputy Todd Blanche, have an interesting choice in front of them in the Adams case. Ho is not going to dismiss without prejudice, as DOJ has moved. And the second circuit unlikely to change that. So do they buy reasonableness points by acquiescing; or do they fight and lose?
