Waluigi's first appearance was in a spin-off tennis game.

Nintendo don't own the exclusive rights to him. Camelot Software have a creative claim as well, and they want to avoid a messy IP legal battle if possible.

Camelot also make other sports games, and so they're safe for him to appear in too.
