We just freed a woman who spent almost 44 years in prison on a false confession. See State ex rel. Bailey v. Horsman, 700 SW3d 1 (Mo. App. 2024) for an excellent description of how it happened and what it took to overturn her conviction. Interrogators still use the same risky methods.

This is so hard to litigate in a criminal case. For example FBI agents do not record all interviews. No video no audio just their partner taking notes. Also, clients are not helpful in their recollection, and testimony from them is often useless. Most people should STFU.

That's a bit extreme, particularly if you're a victim or genuine witness - the police aren't always out to get you!

Be careful, make sure you get a lawyer - and translator if applicable - but total silence isn't necessarily the best policy.

The English system has been, “woke”, about this for at least a decade. American cops are trained that acting nervous means you’re guilty. English cops ask suspects to tell their stories in different ways. They use discrepancies in repeated versions to determine if a suspect should be investigated.
