At the end of the day, both the Constitution and the EO are just words on paper. What matters is what people are doing. If there is no one there to do the work of the Department of Education, then the EO is in effect.

Yes. It matters because any future president can restock any department that has been emptied and reassigned to other agencies unless Congress shuts it down.
