Although I don’t doubt that’s where we’re headed, and it’s poorly written, the memo directs prosecutors to pursue death penalty for undocumented immigrants *who commit capital crimes.* Not just being an undocumented immigrant in general. (Clearly aggressive to capital punishment for them though).

And to ease your mind, I am a JD and worked in federal courts for decades. A federal statute must authorize CP as a penalty. Crossing the border by itself is not CP eligible. As bad as they want it to be and want to scare people.

Only capital punishment for capital crimes. For ex.,there is a statute where if drug distribution resulted in someone’s death, they can pursue capital punishment. Continuing criminal enterprise (gangs as one) can have CP. They can’t just put ppl to death unless fed law authorizes.
