It would be but the Supreme Court’s opinion says that the Office of the President is not specifically mentioned in the 14th Amendment, Section 3, so that doesn’t apply. Basically SCOTUS said that a person cannot be elected dog catcher as an insurrectionist, but they can be elected President. 1/2

The Colorado Supreme Court ruled Trump committed insurrection and shouldn't be on the ballot.

SCOTUS overruled that decision so he could be on the ballot but did not overrule that he committed insurrection.

The presidential oath requires them to uphold the Constitution and the rule of law.
